School, kindergarten, child welfare and social
services employees are exempt from the duty of confidentiality when they
are called to give evidence in a court of law or during a police
investigation of a criminal case. The office of the county governor
grants this exemption.
If the office of the county governor does not grant an
exemption, a court of law can still demand that a witness testimony be
presented. A court of law can also choose to reject a witness testimony,
even if it has been granted by the office of a county governor.
If the person whom the case concerns allows
confidentiality to be broken, exemption from the office of the county
governor need not be sought. Neither must exemption for cases involving a
County Social Welfare Board, or court of law
handling cases regarding the child welfare act, be sought.
